Two Medical Facilities and Medical Equipment Suppliers Accused of Exploiting New York's No-Fault Automobile Insurance Law, Fraudulent Billing

Three lawsuits have been filed against a radiology practice in Brooklyn, N.Y., a medical facility in Queens, N.Y., and a string of durable medical equipment supply companies and their attorneys, who allegedly operated a fraud scheme out of New York, according a GEICO news release.

In a lawsuit against a radiology practice known as Clearview of Brooklyn Medical, insurance company GEICO has accused the facility of faking ownership by a pediatrician, when it was, in fact, allegedly secretly owned by non-physicians. Tatyana Gabinskaya, MD, is reportedly the pediatrician who "owned" the facility. Dr. Gabinskaya has also been listed as the owner of two other medical practices that billed GEICO for a combined $2.3 million in a one-year period, according to the news release.

Another lawsuit alleges a Queens-based multi-disciplinary medical facility, Hollis Medical Care P.C., is secretly owned and controlled by unlicensed, non-physicians. GEICO alleges that unlicensed individuals and entities secretly owned and controlled the medical practice and ran the medical practice for profit, strictly for the purpose of generating fraudulent no-fault claims and without regard to patient care, according to the news release.

The third lawsuit alleges six durable medical equipment supply companies and their attorneys conspired in a fraud scheme that allegedly exploited the no-fault law by submitted exaggerated charges to GEICO. The companies have been accused of misrepresenting the nature and quality of the services provided and has also been accused of never providing any goods and services on certain occasions at all, according to the news release.

In the state of New York, the no-fault law states any person injured in a motor vehicle accident is automatically covered by the Comprehensive Motor Vehicle Insurance Reparations Act. The insurance carrier of a car involved in an accident is responsible for covering the medical costs associated with the driver or any passengers in that car.
