Glenn C. Campbell, MD, an ophthalmologist, is suing Virginia's Riverside Hospital over alleged breach of contract and violation of federal arbitration rules, according to a Virginia Gazette report.
Dr. Campbell claims the hospital has tried to thwart his plans for an outpatient surgery center, which would accompany his Advanced Vision Institute in Williamsburg, Va. The suit in U.S. District Court says the hospital has "undertaken a coordinated effort to block the opening" of the surgery center in order to protect market share and exert "control over various healthcare services."
The disagreement started in 2004, when Dr. Campbell and various physicians signed an operating agreement to run the Doctors Surgery Center in Williamsburg. The contract included a non-compete clause that prevented the partners from opening competing businesses in the surrounding area.
Dr. Campbell says he became dissatisfied with the surgery center run by Riverside and decided to file an application for a Certificate of Public Need to open his own Advanced Vision Surgery Center. Riverside challenged the COPN.
