Novant Health is continuing its fight against Wake Forest Baptist Medical Center's plans for a new ambulatory surgery center, requesting that the North Carolina Supreme Court hear its appeal over the proposed facility, according to a Winston-Salem Journal report.
Novant filed a petition for discretionary review with the court Friday. The health system believes the North Carolina Court of Appeals made an erroneous ruling over its approval of the new surgery center, which is expected to cost Wake Forest Baptist Medical Center $38.7 million.
If the court accepts the case, it will likely render a ruling on the CON application in late 2013. The CON process for this facility began in January 2010.
Novant and Wake Forest Baptist are competing aggressively for market share in the Forsyth County and Triad areas, particularly for outpatient procedures, which are in increasing demand. Novant objected to Wake Forest Baptist applying for the center through an exemption program that allows the state's four teaching hospitals to apply for services and equipment during different cycles than regular hospitals.
