Nearly 100 healthcare organizations and medical societies sent a letter asking HHS to change the format of the Physician Payment Sunshine Act to further protect physicians in case of a dispute, according to a MassDevice report.
The rule, signed last year, requires physicians report payments from manufacturers of drugs, devices, biologicals and medical supplies covered by CMS. Although the medical groups support the intent of the act, the exclusion of CMS from involvement in disputes between manufacturers and physicians poses a problem, the letter states.
"False, misleading, and inaccurate information could be publicly posted on a government website while denying physicians basic due process rights to challenge such information," the letter states.
The groups suggest HHS establish an independent arbiter to handle disputes and provide physicians the opportunity to dispute database entries with a written response. Associations signing the letter include the American Medical Association, the American College of Surgeons and groups from 43 states. The full list is available at MassDevice.
