Texas Oral Surgeon Acquitted in Medicaid Fraud Case

Following an eight-day trial, oral surgeon Gary Morgan Schwarz, DDS, has been acquitted of the remaining eight counts of the original 17 counts of healthcare fraud and conspiracy to commit healthcare fraud against him, according to a report from The Monitor.

The government accused Dr. Schwarz of overbilling Medicaid for tooth extractions performed at his clinic, Valley Oral and Maxillofacial Surgery in McAllen, Texas, between 2007 and 2010. Dr. Schwarz was originally one of six individuals to be targeted in a Medicaid fraud case, with charges handed down in June 2010. Charges against the other defendants except Dr. Schwarz were dropped in March.

“It was a clean sweep for us. The prosecution was absolutely wrong from day one and they wouldn’t listen to anybody," Tony Canales, Dr. Schwarz's lawyer, said in the report.

The U.S. Attorney’s Office declined to comment on the case, according to the report.
