James W. Marshall, MD, operator of walk-in clinic Immediate Medical Care in Monroe, Conn., has pleaded guilty to participating in a four-year conspiracy in which he admitted to illegally writing prescriptions for patients he never met, examined or consulted, according to a Connecticut Post report.
Dr. Marshall wrote more than 145 prescriptions for narcotic painkillers for 75 different patients. A preliminary calculation of his sentencing guidelines suggests an incarceration term between 24 and 30 months with fines of up to $50,000.
The case stemmed from an investigation on an insurance fraud scheme, where victims of automobile accidents were referred to certain lawyers, physicians and medical practitioners in the area who would pad bills to submit to insurance companies.
Dr. Marshall's lawyer said his client has surrendered his license to write prescriptions but is still practicing medicine, according to the report.
