Miami Physician Pleads Guilty to Prescribing Unnecessary Care in $25M Medicare Fraud Scheme

A physician who owned two medical offices in the Miami area has pleaded guilty for his role in a $25 million home health Medicare fraud scheme, according to a news release from the Department of Justice.

Jose Nunez, MD, pleaded guilty to one count of conspiracy to commit healthcare fraud. According to court documents, Dr. Nunez provided home health services and therapy prescription referrals to ABC Home Health Care and Florida Home Health Care Providers — two Miami home health agencies that Dr. Nunez admittedly knew were fraudulent.

The agencies would bill Medicare for expensive physical therapy and home health services that were medically unnecessary or never provided. Dr. Nunez and other physicians played a role in prescribing said unnecessary services from Jan. 2006-March 2009. Court documents say Dr. Nunez advanced the scheme by falsifying patient medical records for conditions that did not exist. As a result of Dr. Nunez's participation in the scheme, the Medicare program was fraudulently billed by approximately $1.5 million.

Dr. Nunez's sentencing has been scheduled for Dec. 5.
