Florida Radiology Clinic to Pay $3M to Settle Alleged Anti-Kickback, Stark Law Violations

A radiology clinic in Palm Beach Gardens, Fla., has agreed to pay $3 million to resolve allegations that it violated the False Claims Act, according to a news release from the Department of Justice.

Midtown Imaging allegedly submitted false claims to Medicare from 2000-2008 by entering into certain leasing and professional services agreements with referring physicians in violation of the Anti-Kickback Statute and Stark Law.

Two whistleblowers, former Midtown radiologists, brought the case forward in 2009. The suit alleged that Midtown entered into improper and prohibited financial relationships with certain physicians and physician groups. The two whistleblowers will each receive $600,000 of the settlement.
