Here are her suggestions.
1. Carefully review all documents related to your current position governing non-compete agreements, trade secrets and confidentially obligations.
2. Determine the state's law on an employee's duty of loyalty to their employer.
3. Consider if your moonlighting position places you at risk of not completely fulfilling the obligations of your current job.
4. Evaluate whether you can successfully create a moonlighting company or hold a second job if you have a fiduciary obligation to your employer in your current position.
5. Seek legal advice from an attorney before starting your moonlighting job.
6. With your attorney's help, share your intention to moonlight with your employer.
