Physician settles allegations he self-prescribed controlled substances

A Pennsylvania physician has agreed to pay $8,000 to resolve allegations he dispensed and distributed Schedule III and Schedule IV controlled substances without an effective prescription or a legitimate medical purpose.

Between March 2020 and December 2022, the Drug Enforcement Administration investigators found that Daniel Rubino, MD, was self-prescribing Schedule III and IV medications while he treated patients at his medical office in Devon, Pa., the Justice Department said in an Aug. 18 news release. 

The DEA investigation found that Dr. Rubino had written approximately 44 prescriptions to himself without the oversight of a prescribing physician and with no initial assessments, reevaluations, or routine monthly visits with a full assessment of his chronic pain and urinalysis.

Dr. Rubino also entered a two-year agreement with the DEA which includes more stringent compliance obligations for handling controlled substances.
