3 recent kickback lawsuits to know

Here are three kickback lawsuits Becker's has covered in the last month:

1. Orthopedic surgeon Tony Tannoury, MD, will pay $200,000 to resolve accusations he violated the Anti-Kickback Statute and the False Claims Act over alleged kickbacks from DePuy Synthes. From at least July 2016 through February 2018 he allegedly received spine devices including cages, rods, screws, plates and modular access and retraction systems for surgeries.

2. Chattanooga, Tenn.-based Erlanger Health System is facing kickback scheme allegations from two former executives. The 2021 complaint was filed by former CFO J. Britton Tabor and former chief compliance officer Alana Sullivan, who were let go in 2019 and 2021, respectively. They alleged that Erlanger offered and provided kickbacks and excessive pay, among other incentives, to physicians who referred patients.

3. Nephrologist Amr Mohamed, MD, in Lexington, Ky., was sentenced to two years in prison for a $14 million kickback and fraud scheme. From March 2018 to April 2019, Dr. Mohamed accepted kickbacks from telemedicine company RediDoc to order medically unnecessary equipment, creams and testing for more than 7,000 Medicare beneficiaries.
