The American Society of Anesthesiologists has filed suit against the medical beverage company, BevMD, for falsely claiming endorsement from the ASA.
ASA claims that BevMD used its name and trademarks without permission and made multiple false and misleading statements about the ASA, including false claims that ASA had approved and endorsed BevMD's Clearfast product.
As a nonprofit association, the society does not test, endorse or approve medical products, said ASA CEO Paul Pomerantz.
The suit has been filed in the United States District Court for the Northern District of Illinois, Eastern Division.
