Anesthesiologist Reaches Settlement With Former Practice Over Breach of Contract Claims

A Madison County Circuit judge is set to hear the status of a settlement in a dispute between a physician and his former anesthesiology practice tomorrow, according to a Madison Record report.

Details of the settlement reached between Michael Zelkind, MD, Piasa Anesthesia Group, and Thomas Brummert, MD, are not available in the case file. Dr. Zelkind sued Dr. Brummert and the anesthesia group in 2007 over breach of contract claims.

According to the report, Dr. Zelkind alleged he was hired in Feb. 2006 to work as an anesthesiologist at the anesthesia group. He alleged the defendants "routinely engaged in practices which deviated from and fell below the accepted standards of medical care."

He alleged the defendants did not use proper pre-anesthesia assessment forms, failed to adequately explain the anesthesia process to patients and used poor clinical judgment in planning anesthesia procedures. He alleged that he was fired after he reported the issues in May 2006.

The suit seeks damages in excess of $50,000 per count on allegations of breach of contract, retaliatory discharge and other claims. The defendants deny the claims.
