Which states have the highest and lowest rates of medical malpractice payouts? The following information is from Diederich Healthcare's analysis of medical malpractice payouts in 2011 as recorded by the National Practitioner Data Bank.

Top six states for medical malpractice payouts
Combined, the following states represent 51.4 percent of payouts in the country:
1. New York — $677,866,050
2. Pennsylvania — $319,710,250
3. Illinois — $242,108,800
4. New Jersey — $221,170,750
5. Florida — $218,123,050
6. California  — $215,519,200

Bottom six states for medical malpractice payouts:
1. Nebraska — $10,577,000
2. Alaska — $6,347,500
3. North Dakota — $4,852,500
4. Wyoming — $4,235,000
5. Vermont — $3,938,250
6. South Dakota — $3,033,750

Here are other findings on medical malpractice payouts:
• In 2011, 36 percent of medical malpractice payouts were for patients aged 40 to 59.
• Fifty-eight percent of total payouts were for female patients, while 42 percent were for males.
• Medical malpractice payouts have been declining since a peak in 2003, when there were the most payouts in the past 20 years. There were about as many payouts in 2011 as in 2010 — there was a .24 percent decrease between the two years.
