3 legislative updates affecting ASCs — September 2018

NC court ruling aligns ASC workers' compensation payments with national average
A North Carolina judge signed an order Sept. 18 affirming a reform to align workers' compensation medical costs with the national average. Session Law 2013-410, Section 33 instructed the Industrial Commission to change its medical fee schedule to tie its medical fee schedule to reimbursement rates to Medicare values.

Georgia considers proposals about upending CON laws
Georgia legislators are discussing the state's certificate-of-need laws preceding a possible reform attempt. The Georgia House Rural Development Council is hearing reform proposals this month.

AHA to CMS: Keep physician-owned hospital ban in Stark Law
The American Hospital Association made comments to CMS Administrator Seema Verma on Stark Law on behalf of its nearly 5,000 members. While the organization supported modifications to Stark Law to promote collaboration within value-based payment models, it urged CMS not to alter the ban on physician-owned hospitals.
